Redstone Texts provides political and enterprise communications services, including but not limited to: SMS and MMS message delivery, programmatic and connected television advertising, consumer and voter data records, identity resolution, custom intent targeting, and related consulting and managed services (collectively, the "Services").
The Site is informational in nature. Actual Services are provided under separate written agreements between Redstone Texts and its clients.
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:
All content on the Site, including text, graphics, logos, images, and software, is the property of Redstone Texts or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Site without our prior written consent.
When you submit an inquiry through the Site, you represent that the information you provide is accurate and complete. Submission of an inquiry does not create a binding contract or obligate Redstone Texts to provide any services. All service engagements are subject to a separate written agreement.
Clients who use Redstone Texts services for SMS, MMS, or other outreach communications are solely responsible for ensuring that their use of those services complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the California Consumer Privacy Act (CCPA), and all state and local equivalents. Redstone Texts provides compliance support as part of its managed services but does not accept legal liability for client content or targeting decisions.
Consumer and voter data records made available through our Services are licensed for use in lawful commercial and political communications. Clients may not use such records for any purpose that violates applicable law, including unlawful discrimination, harassment, or stalking. Redistribution or resale of records without a separate written data licensing agreement is strictly prohibited.
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. REDSTONE TEXTS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REDSTONE TEXTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall our total liability to you for all claims arising from or related to your use of the Site exceed one hundred dollars ($100.00).

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Redstone Texts with respect to your use of the Site, and supersede all prior agreements, understandings, and representations.
